₦250m Compensation for Air-fighter Lady



Chief (Barrister) Olawale Ojoge-Daniel, a legal practitioner, has written an open letter to President Bola Ahmed Tinubu, GCFR, demanding a compensation of ₦250 million for the Ibom Air Passenger, Ms Comfort Emmanson. The full text hereunder:

Subject: A NATIONAL DISGRACE: The Inhuman, Savage, and Unlawful Treatment of a Female Passenger by Ibom Air Officials and Collaborators – A Call for Immediate Justice


Your Excellency,


With a deep sense of outrage, pain, and unshakable conviction, I write on behalf of every right-thinking and law-abiding Nigerian to condemn in the strongest terms the barbaric, sadistic, and savage treatment meted out to a female passenger aboard an Ibom Air flight in Lagos on 10th August 2025.

Reports and verified eyewitness accounts confirm that the said passenger was:


Prevented from disembarking after the aircraft landed,


Physically assaulted and dragged in a manner reminiscent of jungle justice,


Stripped of her dignity and partially nude in full public glare,


Handed over to security operatives without due process,


Arraigned in court in indecent condition, and


Remanded in prison custody without any semblance of fair hearing.


This appalling act is nothing short of the public debasement of womanhood, an act of gender-based violence, and a direct affront to Section 34(1) of the 1999 Constitution (as amended) which guarantees the dignity of the human person, prohibiting torture, inhuman or degrading treatment.


LEGAL ANALYSIS AND VIOLATIONS


1. Breach of the Right to Dignity of the Human Person

Under Section 34(1)(a) of the Constitution and Article 5 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act, every person is entitled to respect for their dignity and shall not be subjected to torture, cruel, inhuman, or degrading treatment. Dragging, stripping, and humiliating a woman in public glare is the clearest violation of this right.

2. Breach of the Right to Personal Liberty and Fair Hearing

Sections 35 and 36 of the Constitution enshrine the right to personal liberty and fair hearing. Arbitrary detention and hurried arraignment without allowing the accused proper legal representation is unconstitutional.

3. Gender-Based Violence (GBV)

The Violence Against Persons (Prohibition) Act (VAPP Act) criminalizes acts of violence, intimidation, humiliation, and indecent exposure against women. Those involved in this act have committed criminal offences punishable under this law.

4. Civil Aviation Regulatory Breaches

The Civil Aviation Act 2022 and related NCAA Regulations require carriers to treat passengers with respect, safety, and dignity at all times. The actions of Ibom Air’s crew and collaborating security personnel amount to gross professional misconduct and breach of statutory obligations to passengers.


CIVIL AND CRIMINAL LIABILITIES


Those involved are liable:


Criminally, for assault, battery, indecent exposure, unlawful detention, and gender-based violence.


Civilly, for damages for defamation, breach of contract of carriage, emotional distress, and violation of constitutional rights.


The airline as a corporate entity is vicariously liable for the unlawful acts of its employees carried out in the course of their duties.


DOUBLE STANDARDS AND SELECTIVE ENFORCEMENT


This incident, when compared to the much-publicized case involving popular musician Kwam 1, reveals an alarming double standard in the application of law and policy. The heavy-handed treatment of this helpless woman stands in stark contrast to the restraint and courtesy extended to other high-profile individuals accused of wrongdoing in aviation spaces.


DEMANDS FOR JUSTICE


Immediate release of the victim from unlawful detention.


Public apology from Ibom Air and all security agencies involved.


Payment of substantial compensation (not less than ₦250 million) to the victim for the physical, emotional, and reputational harm suffered.


Immediate suspension and prosecution of all crew members, security operatives, and collaborators involved.


Urgent directive from the Minister of Aviation to the NCAA to investigate and sanction Ibom Air for regulatory breaches.


Institution of a Presidential Task Force on passenger rights protection in Nigerian airports.


Your Excellency,

Those who brutalized this innocent woman are animals in human flesh and must not be allowed to walk freely among civilized men and women. Their conduct is a disgrace to our nation, a slap in the face of constitutional democracy, and a loud reminder that jungle justice still festers in our institutions.

It is your duty, as President of the Federal Republic of Nigeria, to ensure that justice is not only done but seen to be done – swiftly and without compromise.
